Which is the right appeal form?

Find the right appeal form as follows.

 

The Local Authority has refused to secure (undertake) an EHC assessment of your child or young person following a request by the parents or the school.

For appeals concerning decisions made on or after 3 April 2018 use this Form (Form 35A)

 

The Local Authority refuses to secure (issue) an EHC plan, after concluding an EHC assessment.

For appeals concerning decisions made on or after 3 April 2018 you will need this Form (Form 35)

 

The Local Authority has issued a final EHC plan (or amended or replaced a previous EHC plan) and you disagree with one or more of the following Sections:

For appeals concerning decisions made on or after 3 April:

 

Section B (special educational needs)

Section F (special educational provision) 

Section I (the school or type of school named in the EHC plan

or the Local Authority has not named a school in the EHC plan

the Health and Care sections (C, D, G and/or H) can now be appealed but only if an appeal is made against an educational section of the EHC plan

The Local Authority decides not to replace or amend the EHC plan following a review.

For appeals concerning decisions made on or after 3 April 2018 you will need this Form (Form 35)

 

The Local Authority has refused to arrange a reassessment of your child's special educational needs (following a request by the parent or child's school) if the local authority has not made an assessment for at least six months.

For appeals concerning decisions made on or after 3 April 2018 you will need this Form (Form 35)

 

The Local Authority decides not to change the EHC plan after reassessing the child.

For appeals concerning decisions made on or after 3 April 2018 you will need this Form (Form 35).

 

The Local Authority decides to stop maintaining the child's EHC plan.

For appeals concerning decisions made on or after 3 April 2018 you will need this Form (Form 35).
